Fyrwood Terms of Service
Welcome to Fyrwood. These Terms of Service ("Terms") govern your use of the Fyrwood platform ("Fyrwood," "we," "our," or "us"). By creating an account or using Fyrwood, you agree to these Terms. If you do not agree, please do not use the platform.
1. Our Role
Fyrwood is a marketplace platform that connects tree companies, firewood producers, and buyers. We do not own, transport, store, or guarantee any logs, firewood, or related services. We are not responsible for the actions of users on the platform.
2. Users and Responsibilities
Tree Companies
- Responsible for safe, lawful delivery and unloading of logs.
- Must have permission to drop logs at any delivery site.
- Agree to handle all equipment and property with care; Fyrwood is not responsible for damages.
Firewood Producers
- Responsible for accurately representing inventory and availability.
- Must comply with local laws and regulations for storing and selling firewood.
- Responsible for managing deliveries, pickups, and communication with tree companies and buyers.
Buyers
- Responsible for timely payment for orders.
- Responsible for ensuring access for deliveries at the designated address.
- Any issues with product quality, delivery, or disputes must be resolved directly with the producer.
3. Payments
- All payments are processed securely through Stripe.
- Fyrwood may charge transaction fees or commissions on certain payments.
- By using Fyrwood, you authorize us to process payments and distribute payouts.
4. Refunds and Disputes
Log Drops Are Final
Once a firewood producer accepts a log drop through Fyrwood, the delivery is considered final. Log drops cannot be returned, refunded, or picked up by the delivering tree company or by Fyrwood. The producer assumes full responsibility for any logs accepted, including storage, processing, or disposal.
- Refunds and disputes are handled directly between users (tree companies, producers, buyers).
- Fyrwood does not guarantee refunds or assume responsibility for disputes but may facilitate communication.
5. Property & Risk
- All deliveries, drops, and transactions are performed at the users' own risk.
- Fyrwood is not responsible for any injury, loss, or damage to persons, property, or equipment arising from use of the platform.
6. Account Conduct
- Users must provide accurate information and use Fyrwood in good faith.
- Misuse, fraud, harassment, or unlawful activity is prohibited.
- Fyrwood reserves the right to suspend or terminate accounts that violate these Terms.
7. Limitation of Liability
- Fyrwood's total liability to any user is limited to the amount that user paid through the platform in the past 12 months.
- Fyrwood is not liable for lost profits, indirect damages, or disputes between users.
8. Governing Law & Disputes
- These Terms are governed by the laws of the Commonwealth of Pennsylvania.
- Any disputes will be resolved through binding arbitration in Pennsylvania, unless otherwise required by law.
9. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated, and continued use of the platform means you accept the updated Terms.
